Terms and Conditions for Recycling Service 

The recycling service for products is provided by iFP Green Technology Investment Limited Taiwan Branch (“iFP Green Technology”) through Apple Asia LLC, Taiwan Branch and any of its affiliates, subsidiaries and branches (collectively “Apple”) at no cost to customers. “Recycling service” means the responsible reuse of the product or its parts. To the extent permitted by applicable law, Apple hereby disclaims and excludes any and all warranties of any kind, express or implied. “Customer” means the undersigned owner of the product. “Product” means iPhone or iPad or such other Apple products as determined by iFP Green Technology and Apple from time to time for the purposes of the Recycling Service.

Eligible devices

“Eligible Device” means any device that is eligible for this Recycling Service as determined by iFP Green Technology and Apple in their sole discretion.

 

Apple is an agent of iFP Green Technology

The customer understands, acknowledges and agrees that Apple is acting as an agent for iFP Green Technology and that Apple is only collecting the Eligible Device on behalf of iFP Green Technology.

You are the owner of the Eligible Device

The customer represents and warrants that: 

-       They are the sole owner of the Eligible Device; there are no liens, encumbrances or security interests in or attached to the Eligible Device; and they are legally entitled to sell and dispose the Eligible Device 

-       They are not an Apple reseller

-       They are at least 20 years old

Ownership transfers to iFP Green Technology

Upon Apple receiving and accepting the Eligible Device, ownership of that Eligible Device transfers to iFP Green Technology, and the customer disclaims any further right or interest to the Eligible Device or any items contained therein, including without limitations, the right of ownership and the right of disposal. 

Purchase of new product

Apple, acting as an agent for iFP Green Technology, will advise the customer of the assessed value of his/her Eligible Device and obtain the confirmation with customer's signature. This is the value Apple will on behalf of iFP Green Technology pay the customer for the Eligible Device; iFP Green Technology makes no representation (express or implied) about the market value of the Eligible Device or the price the customer may be able to obtain elsewhere. 

No return or exchange

Please note that all Apple and Beats products purchased at an Apple Retail Store in Taiwan cannot be returned or exchanged under this policy.

General terms and conditions

This recycling service is provided for lawful purposes only, and the customer understands and agrees that: 

-       They have sole responsibility for keeping a separate backup copy of any files or data before transferring ownership of the Eligible Device to iFP Green Technology, and that they have taken reasonable steps to remove files and data that are deemed personal or confidential. The recycling service does not include data recovery or removal. Apple and iFP Green Technology accept no responsibility or liability for lost files or data.

-       They are responsible for ensuring the SIM card is removed from the Eligible Device, and that iFP Green Technology and Apple are not responsible for any costs arising from their failure to remove the SIM.

-       They must ensure that the Eligible Device is legally obtained. The customer shall not provide iFP Green Technology and Apple with any Eligible Device obtained through illegal means, such as stealing, robbery, fraud, counterfeit or smuggle, or any Eligible Device that the customer has no right of disposal. Customer shall provide the ID and some other relevant information to prove that the Eligible Device has been legally obtained. The customer shall be solely liable for any civil, criminal or administrative liabilities in connection with any dispute due to the fact that the Eligible Device was illegally obtained or the customer had no right of disposal, and shall also indemnify iFP Green Technology and Apple against any relevant loss. iFP Green Technology may turn in the suspected Eligible Device to relevant law enforcement authorities and cooperate with the authorities in any investigation, if it finds that there is any suspected illegal conduct. 

-       It may be legally necessary to provide to law enforcement the unique numeric identifier of the customer’s Eligible Device and the customer’s personal information as provided under this recycling service.

-       They indemnify Apple and iFP Green Technology and any of their directors, officers, employees, affiliates, subsidiaries or agents from and against any claims brought against any of them arising from performing this recycling service, or for any breach of these terms and conditions by the customer.

-       iFP Green Technology may cancel the recycling transaction with the customer under its sole and reasonable discretion if the customer breaches this Terms and Conditions. The relevant Eligible Device will be returned to the customer, and the customer agrees to return the value and other relevant benefit (if any) as requested by iFP Green Technology. 

-     Information collected by iFP Green Technology will be dealt with in accordance with the iFP Green Technology Privacy Policy, available at: https://service.greenifp.com.tw/htmls/ServiceTerms.html.

-   iFP Green Technology and Apple will not be liable for any special, indirect, incidental or consequential damages resulting from the recycling service. To the extent permitted by law, iFP Green Technology and Apple’s entire liability, if any, from any cause whatsoever with respect to this service shall not exceed NT$250.

-     Apple and iFP Green Technology may reject, cancel, suspend or restrict the recycling service if it is prohibited or restricted by the applicable law. The recycling service may not be available in all Apple business areas and locations.

-     iFP Green Technology and Apple reserve the right to refuse, cancel or limit recycling services for any reason without incurring any liabilities.

-     The recycling service is not redeemable and has no cash value.

Governing Law and Dispute Resolution

This Terms and Conditions shall be governed by the laws of Taiwan (R.O.C). Any dispute with respect to the execution and interpretation of this Terms and Conditions shall be settled through friendly consultation by the parties. If the dispute cannot be resolved through consultation, any party may submit the relevant dispute to Taiwan Taipei District Court.
